1. Acceptance of Terms
By accessing and using Zion App ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.
2. Description of Service
Zion App is a church management platform that provides:
- Kids Ministry check-in and check-out services
- Member and group management
- Event calendar and scheduling
- Communication tools including email and SMS notifications
- Guardian portal for parents and caregivers
3. Data Controller and Data Processor Roles
Important: Understanding Data Responsibilities
When using Zion App, it is essential to understand the distinct roles and responsibilities regarding data collection and processing:
Your Church as Data Controller
Your church or religious organization ("Church") acts as the Data Controller. This means your Church:
- Determines the purposes and means of processing personal data
- Is responsible for obtaining proper consent from members, guardians, and parents
- Must ensure compliance with applicable privacy laws (COPPA, GDPR, state privacy laws)
- Is responsible for the accuracy and security of data entered into the system
- Must respond to data subject access requests from members
- Bears primary liability for data protection compliance
- Must maintain records of consent for children's data collection
Zion App as Data Processor
Zion App acts as the Data Processor. This means Zion App:
- Processes personal data only on behalf of and under instructions from your Church
- Provides the technical platform and infrastructure for data storage and processing
- Implements appropriate security measures to protect data
- Does not use personal data for any purpose other than providing the Service
- Does not sell, share, or disclose personal data to third parties except as required to provide the Service
- Will assist your Church in responding to data subject requests upon request
Church Responsibilities for Kids Ministry
When using Kids Ministry features, your Church specifically agrees to:
- Obtain verifiable parental consent before collecting children's information
- Inform parents about what data is collected and how it will be used
- Provide parents with access to their children's data upon request
- Delete children's data when requested by parents or when no longer needed
- Train staff on proper data handling and child safety procedures
- Maintain physical security at check-in/check-out locations
- Verify the identity of guardians before releasing children

4. User Accounts
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
5. SMS Messaging Terms
Consent to Receive SMS Messages
By providing your mobile phone number and checking the SMS opt-in box, you expressly consent to receive recurring automated text messages from Zion App regarding:
- Kids Ministry check-in and check-out notifications
- Pickup alerts when your child is ready
- Incident reports and urgent safety notifications
- Service reminders and updates
This consent is not a condition of any purchase or use of the Service.
Message Frequency & Costs
- Message frequency varies based on your activity and preferences
- Message and data rates may apply depending on your mobile carrier plan
- You are responsible for any charges from your wireless carrier
Opting Out
- You may opt out at any time by replying STOP to any message
- After opting out, you will receive a confirmation message
- You may also disable SMS notifications in your account settings

Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. SMS notifications are provided as a convenience and should not be relied upon as the sole method of communication for emergencies.

6. Privacy

7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service
- Upload malicious code or content
- Impersonate any person or entity
- Collect or harvest user data without consent
8. Children's Information and COPPA Compliance

The Service collects and stores information about children for the purpose of providing Kids Ministry services. This information is collected with the consent of parents or guardians and is used solely for:
- Facilitating check-in and check-out processes

Parental Rights
Parents and legal guardians have the right to:
- Review their child's personal information stored in the system
- Request correction of inaccurate information
- Request deletion of their child's information
- Refuse further collection of their child's information
- Withdraw consent at any time

Church Obligations
Churches using Kids Ministry features must obtain verifiable parental consent before collecting any information about children under 13. This includes:
- Providing parents with clear notice about data collection practices
- Obtaining signed consent forms or electronic consent
- Maintaining records of parental consent
- Honoring parental requests regarding their children's data
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Zion App and are protected by international copyright, trademark, and other intellectual property laws.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date.
